Letter to the Habeas Corpus Resource Center

Below is a letter to the Habeas Corpus Resource Center (7 April 2010), also sent in copy to the California Governor's Office.

We the undersigned, residents of Santa Cruz County,* of the State of California, consider that the mandate of your office is to represent Habeas petitioners where California law is violated, and not limited to representation of California State residents. If it is not sufficiently understood, under the statutes granting your mandate, then one may reference the State Constitution – the section on the obligations of the Attorney General, to foster and secure adequate and uniform enforcement of the codes of the State, that such obligations extend to juridical settings external of the State.

We inform your office of the violation of the terms of the « Treaty on the Final Settlement with Respect to Germany of 1990 », by the Administration of George W. Bush, in the pursuit of that Administration to aggress the Republic of Iraq. According to the primacy of law in these United States, the Constitution is the first source of law, the treaties of the United States conducted with foreign governments, secondary, and the State law of California, subordinate to the preceding.

The transfer of the authority by the Governor of this State over our National Guard units to the federal Administration under the circumstance of the latter's violation of the mentioned treaty, constitutes an illegal act. State law is obliged to adhere to the treaty, and/or treaties, as below, of the signature of the various federal Administrations.

The Geneva Conventions further oblige that an occupying power in warfare not transfer custody of prisoners of war, to another entity, unless assurances are evident that the transferee entity would oblige to the same said Conventions, in the treatment of prisoners. Your office is thereby requested to immediately initiate the filing of habeas petitions on behalf of, in primacy, Republic of Iraq government officials, of the government extant at the initiation of, breach of International law, United States' aggressions of March 18, 2003, of the signature of President George W. Bush, his determination to Congress pursuant to the terms of Public Law 107-243, and, of secondary, habeas petitions on behalf of other Iraqi officers and citizens.

Further is the request that your office consign, with the deputy prime minister of the Republic of Iraq, H.E. Tariq Aziz, a diplomatic statement to the Security Council of the United Nations, informing the said Council of the United States' breach of the pledge of the Hon. Warren Christopher, Secretary of State, conveyed to the said Council, by Chargé d'affaires a.i. Edward W. Gnehm, on the date of 6 April 1995, document reference UN A/50/153 – S/1995/263.
